The draft cultivation limits: five plants and 750 grams, in practice

The draft regulations under the Cannabis for Private Purposes Act were published on 2 February 2026 and public comment closed on 5 March. They are not final, but they set the shape of what a legal private grower will look like, so it is worth reading them now.

The numbers. You may hold up to 750 grams a day, at home or out in public. You may cultivate up to five plants at a time. Transport is capped at 750 grams, and the load has to sit concealed in a boot or closed compartment, not on the seat, and not being handled while you drive.

Five plants is the interesting number for anyone who grows for quality rather than volume. It is not much, but it is enough to run a proper selection and a proper harvest if you treat each plant as a data point instead of a production unit. It pushes you toward the opposite of a commercial mindset: fewer plants, more attention, better material.

That is a natural fit for terroir work. One cultivar, a handful of plants, soil you actually know, a climate you work with rather than fight. The five plant cap does not stop you from doing that. It stops you from doing it at scale, and scale was never the point of this kind of growing.

The transport rule is where most people will trip. The draft says conceal it and leave it alone while you drive. If your harvest is visible on the passenger seat, you have handed an officer a reason to search, no matter how far under the 750 gram limit you are.

One correction worth making: expungement of old cannabis convictions is not automatic. There is a form to file. If you or someone you know carries an old record, look into it rather than assuming it cleared itself.

None of this is law yet. But the draft is the clearest signal so far of where the line will be drawn, and planning your grow around it now costs nothing.
